These Terms of Service govern access to and use of Nexudo Mail, the business email hosting service operated by Nexudo Tech Solutions. By creating an account or using the service, you agree to these Terms.
The service
Nexudo Mail provides domain-based email hosting, related admin tools, and optional features described on our Features and Pricing pages. Features may vary by plan. We may improve, add, or discontinue functionality with reasonable notice when material to your use.
Accounts and eligibility
You must provide accurate registration information and keep admin contacts current. You are responsible for safeguarding credentials and for activity under your organization’s accounts. You must be legally able to enter a binding contract and use the service for lawful business purposes.
Domains and customer content
You retain ownership of your domains (subject to your registrar) and of content in your mailboxes. You grant us a limited license to host, transmit, filter, back up, and display that content solely to provide Nexudo Mail. You are responsible for having rights to the domains and data you connect.
Plans, fees, and taxes
Fees are based on the plan and seats you select. Unless stated otherwise, subscriptions renew automatically until canceled. Prices may change with notice for subsequent billing periods. You are responsible for applicable taxes. Non-payment may result in suspension or termination.
Acceptable use
You must comply with our Acceptable Use Policy, including prohibitions on spam, phishing, malware, and unlawful content. We may suspend or terminate accounts that violate AUP or create risk to the platform or others.
Support and availability
Support channels and response targets depend on your plan. We aim for high availability but do not guarantee uninterrupted service except where a specific uptime commitment is stated for your plan. Scheduled maintenance will be communicated when practical.
Third-party services
Nexudo Mail may interoperate with third-party DNS providers, payment processors, and email clients. We are not responsible for those third parties’ products or policies.
Intellectual property
Nexudo Mail branding, software, and site content are owned by Nexudo Tech Solutions or its licensors. You may not copy, reverse engineer, or resell the service except as allowed in writing (for example Enterprise white-label arrangements).
Disclaimer and limitation of liability
THE SERVICE IS PROVIDED “AS IS” TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. OUR TOTAL LIABILITY ARISING FROM THESE TERMS OR THE SERVICE IS LIMITED TO THE FEES YOU PAID FOR NEXUDO MAIL IN THE TWELVE MONTHS BEFORE THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR BUSINESS.
Indemnity
You will defend and indemnify Nexudo Tech Solutions against claims arising from your content, your domains, your users’ misuse of Nexudo Mail, or your violation of these Terms or applicable law.
Suspension and termination
You may cancel according to your billing settings. We may suspend or terminate for breach, non-payment, legal risk, or extended inactivity. After termination, mailbox access may end and data may be deleted after any applicable retention window. Export mail before closing when possible.
Governing law
These Terms are governed by the laws applicable to Nexudo Tech Solutions’ principal place of business, without regard to conflict-of-law rules, unless mandatory local consumer or data laws provide otherwise.
Changes
We may update these Terms by posting a revised version with an updated date. Material changes will be highlighted when reasonable. Continued use after the effective date constitutes acceptance where permitted.
